CAROLE LOMBARD. Typed DS: "Carole Lombard" under "Agreed To", 2p, 8x11, separate sheets. Los Angeles, California, 1939 June 6. In letter form to Lombard from RKO Radio Pictures, Inc. Amendments to an April 3, 1939 contract for her role in a film tentatively titled Memory of Love. In part: "The negative cost of the Motion Picture shall be computed and determined by the Corporation in accordance with the method and system now being used by the Corporation in the determination of the negative cost of the Corporation's motion pictures as to direct studio costs and as hereinafter provided as to indirect studio costs, and shall be deemed to mean the final cost of producing the Motion Picture, including the fixed compensation payable to the Artist pursuant to this agreement, but excluding the contingent compensation, if any, payable to the Artist pursuant to this agreement and the contingent compensation payable to any of the Corporation's other employees employed in connection with the motion picture...By contingent compensation is meant any compensation predicated upon the gross receipts or net profits of the Motion Picture...Within ninety (90) days after the date of the completion of the production of the Motion Picture the Corporation will furnish the Artist with a certified statement in the usual form of the cost of producing the negative of the Motion Picture. Any such statement so furnished by the Corporation shall be deemed conclusively to be correct unless the same shall be objected to by the Artist or changed by the Corporation within a period of one hundred twenty (120) days after the date of the submission thereof to the Artist...."
